Terms + Conditions Contract - Mandy Dempsey PHotography - South Loop farmers Market - Water Tower Place

1. CANCELLATION POLICY: In the event of an emergency and you need to reschedule, please give the photographer 24 hours notice prior to your session. Payment is non-refundable but may be transferred to another service with Mandy Dempsey Photography. Payment will be transferred solely based on the monetary value and not this special offer and is to be redeemed within 6 months cancellation notification. NO CALL NO SHOW, by the client, will result in no payment transferred to another service with Mandy Dempsey Photography. No refunds are issued. All sales are final.

2. PROOFING GALLERY EXPIRATION: You are required to make your portrait selections by the proofing gallery expiration date. If your proofing gallery has expired and you would like to view it after the gallery has expired, the client will pay a $30 reissue fee to view the proofing gallery. Your $30 fee will be transferred to the total of your portrait order. If no additional selections are made aside from what is included in the session fee, the fee is retained by the photographer. This also applies to once your initial order is placed. The gallery will close and to gain access, the $30 reissue fee is to be paid, as indicated above.

3. PROOFS: Proofs are for viewing to make your portrait selections. You agree to NOT screenshot any proofs. The watermark on the proof will also remind you of this.

4. ADDITIONAL PORTRAIT SELECTIONS: Additional portrait selections are available for purchase from the proofing gallery.

5. RETOUCHING: Final retouches will be made to all portraits in your order. Overall retouch (human - eye clarity, whites of teeth and eyes, Natural skin retouch to face and my global editing style. - anything else is an additional charge) to make the portrait pop. The proofs have been partially edited and had the photographer's invested time. Proofs are not shown as RAW images. Pet hair is inevitable and will be reduced as much as possible. If the leash is extended, I will do my best to remove the extended leash.

6. DELIVERABLES: Proofing gallery and final gallery dates vary. You'll receive a follow up email the day after your session with specific information on this topic. All portraits from your proofing gallery are released as a high resolution digital download. Please no editing or altering images provided by Mandy Dempsey Photography.

7. RUSH FEE: Expedited orders. If you would like your final portrait order brought to the top of my editing queue, a rush fee can be applied to accommodate. Rush fee is based on the amount of images and the photographer's availability.

8. FINAL GALLERY ACCESS: The client's online gallery of final digital portraits will be accessible for 3 months after delivery. The client is responsible for downloading their images and storing them on their own secure device.

9. PUNCTUALITY: It's important for the client to be on-time for their session. It's best to arrive early and enjoy the market before your session. If you are late, it will take away from your session time. Please contact the photographer if you are going to be late to see if arrangements are available.

10. LEASH AND COLLAR: Leash and collars will be in the portraits if worn during the portrait, so please bring one that will look nice and neutral.

11. HANDLING: The Client is responsible for handing their pet during the session and their pet's safety.

12. PET BEHAVIOR: If your pet is displaying aggressive behavior towards the photographer, the photographer has the right to terminate the session. Safety first. If your pet is displaying distressed and anxious behavior, especially in the studio environment, the client is encouraged to only book outdoor sessions in the future. Some pets are not comfortable in a studio environment. Honor limitations.

13. PET ACCIDENTS: Accidents happen. If your pet has an accident and/or damages the photographers property, the photographer will approach the incident on a case by case basis.

14. CELL PHONE PHOTOS: No cell phone photos allowed in the portrait area. Behind the scenes video is okay.

15. CLIENT USAGE: All photos you receive from this session are for personal use only. No tagging third party accounts when posting to social media (in photo or caption). No third party distribution (this includes collaborators that are not Mandy Dempsey Photography) or use for business representation or promotion. No commercial use or resale. In the event that you do these actions, you will be asked to take action to align with the terms + conditions. Failure to take action to align with terms + conditions will result in the inability to book future photography services.
